One to be fined 1 million 350 thousand soums for not wearing a mask. How realistic is it?

Against the backdrop of an increase in the number of people infected with coronavirus in Uzbekistan, reports appeared on social networks that administrative fines will be imposed on those who appear on streets and in public places without a medical mask.

It should be noted that after the start of the coronavirus pandemic in Uzbekistan, all institutions were allowed to operate. But nobody canceled the rules of sanitation and hygiene.

Indeed, according to Article 54-1 of the Administrative Responsibility Code (Violation of the rules for combating epidemics), being without a mask in public places, violating the special requirements of the competent authority in the event of the emergence and spread of quarantine and other dangerous human diseases, is punishable by a fine of up to 5 BCAs.

Five-time BCA is exactly 1 million 350 thousand soums. But this is not a fixed amount of the fine. The Code says: up to 5 BCAs.

Then, if the rumors turn out to be true and the fines are applied again, how much will the “maskless walk” cost?

Article 25-2 (fine) of the Administrative Responsibility Code establishes that the minimum fine imposed on citizens cannot be less than one fiftieth (5,400 soums) of the size of the base calculating amount, and for officials – less than one tenth (27,000).

You are an ordinary citizen. Article 54 does not specify a lower limit for the fine. Thus, the minimum fine to be imposed on you is one-fiftieth of 1 BCA, that is, 5,400 soums. This is the amount that most citizens were previously fined for walking the streets without a medical mask.

Yes, there are those who were previously “caught” and were fined as much as 5 BCAs, but this amount of the fine could be challenged in court and reduced to 5,400 soums.

In most cases, these fines are imposed under Article 53 (violation of sanitary legislation – garbage disposal), Article 54 (violation of the rules for combating epidemics – walking without a mask), Article 56-1 (use of tobacco products in public places), Article 138 (Violation of traffic rules by pedestrians and other road users).

Therefore, if you clearly commit one of these offenses and you are stopped by a police officer and scanned your fingerprint, try to find out if you were fined and the exact amount.

Because if you pay the fine within 15 days of the offense, you will be given a 30% discount.
